9. APPROVAL OF SETTLEMENT
Description
This is a mediated settlement agreement reached by the parties, subject to School Board approval, with respect to parcel 6 in the on-going eminent domain action in which the School Board is acquiring property for a school site in North Port.

Recommendation
That the School Board approve the settlement with respect to parcel 6 in the case of School Board v. Adams Homes, et al., as presented.

10. APPROVAL OF AGREEMENTS BETWEEN THE SCHOOL BOARD OF SARASOTA COUNTY, FLORIDA, AND THE SOUTH COUNTY YMCA TO PROVIDE CHILD CARE SERVICES
Description

The South County Family YMCA agrees to provide child care services in conformance with 65C-22, Florida Administrative Code, "Child Care Standards" at Laurel Nokomis.

11. APPROVAL OF CELL TOWER GROUND LEASE
Description

That the School Board approve the agreement regarding the cell tower ground lease as presented. This agreement recognizes that the original lessee has assigned the lease to another party which it has the right to do under the lease. This has no economic impact on the Board.

FIELD TRIPS

12. APPROVAL OF BOOKER HIGH SCHOOL COLLEGE FOR EVERY STUDENT (CFES) SUMMER EXPLORE PROGRAM FIELD TRIP TO TRINITY UNIVERSITY IN DUBLIN IRELAND JUNE 16-24, 2012
Description

Students will be given the opportunity to take part in a week long pre-college summer school program at Trinity College of Dublin that will enhance each students reading, writing, and public speaking skills. Students will also receive assistance with college application, essays, and resumes.



Recommendation
That the Booker High School CFES Summer Explore Program field trip to Dublin, Ireland, June 16-24, 2012 be approved.

13. APPROVAL OF SARASOTA HIGH SCHOOL SPEECH AND DEBATE CLUB COMPETITIVE SPEECH AND DEBATE TOURNAMENT FIELD TRIP TO BALTIMORE, MARYLAND MAY 25-28, 2012
Description
This is a competitive Speech and Debate team which competes in ten separate events at each tournament. Students compete in speaking contests and earn membership privileges in the Catholic Forensic League, Florida Forensic League, and National Forensic Leagues.

Recommendation
That the Sarasota High School Speech and Debate Club field trip to Baltimore, Maryland on May 25, 2012 through May 28, 2012 be approved.

14. APPROVAL OF SARASOTA HIGH SCHOOL SPEECH AND DEBATE CLUB FIELD TRIP TO INDIANAPOLIS, INDIANA JUNE 9, 2012 THROUGH JUNE 16, 2012
Description

15. APPROVAL OF TATUM RIDGE ELEMENTARY AND BAY HAVEN ELEMENTARY FIELD TRIP TO AMES, IOWA FOR ODYSSEY OF THE MIND WORLD COMPETITION
Description

Tatum Ridge Elementary and Bay Haven Elementary students will participate in the Odyssey of the Mind World Competition in Ames, Iowa, May 22 - 27, 2012.



Recommendation

That the field trip for Tatum Ridge Elementary and Bay Haven Elementary to Ames, Iowa, for the Odyssey of the Mind World Competition, May 22 - 27, 2012, be approved.



16. APPROVAL OF THE SARASOTA HIGH SCHOOL FIELD TRIP TO PITTSBURGH, PENNSYLVANIA ON MAY 12 - 18, 2012
Description
Student won the regional science fair and qualifies to participate in the premier high school science competition taking place in Pittsburgh, Pennsylvania. This aligns directly with the MaST Research Institute as the student will have an opportunity to present her research to the judging committee, as well as compete and converse with other students from around the country.

Recommendation
That the Sarasota High School field trip to Pittsburgh, Pennsylvania on May 12 - 18, 2012 be approved.

EXPULSIONS

17. APPROVAL OF EXPULSION CASE NO. 11-397
Description
School Board Policy 5.34(4) permits the Board to hold in abeyance, the expulsion of a student, if the student participates in a recognized alternative-to-expulsion program.  This student is being placed in AMIKids alternative school per Department of Juvenile Justice.

Recommendation
That Expulsion Case No. 11-397, be held in abeyance per School Board Policy 5.34.

18. APPROVAL OF EXPULSION CASE NO. 12-241
Description

The student listed in Expulsion Case No. 12-241, is in violation of an accepted Expulsion Settlement Agreement for alternative school placement.  On January 11, 2012, the student listed in Expulsion Case No. 12-241, violated School Board Policy 5.322, Prohibition Against Use, Sale, or Possession of Alcohol or Drugs.  It is the recommendation of the Superintendent, that the student be expelled from the Sarasota County Schools until January 15, 2013.



Recommendation
That in accordance with provisions of Sections 1006.07(1)(a)(b), Florida Statutes and School Board Policy 5.34, the holding of a hearing having been waived by the student/parent, the recommendation as specified in Expulsion Case 12-241, to expel the student referenced therein from the Sarasota County Schools, be approved effective immediately for the remainder of the 2011-2012 academic year, the 2012 summer session, until January 15 of the 2012-2013 academic year.

19. APPROVAL OF EXPULSION CASE NO.12-250
Description
The student listed in Expulsion Case No. 12-250, is in violation of an accepted Expulsion Settlement Agreement for alternative school placement.  On March 26, 2012, the student listed in Expulsion Case No. 12-250, violated School Board Policy 5.34(1)(d), Battery on Another Student/Bullying.  It is the recommendation of the Superintendent, that the student be expelled from the Sarasota County Schools until January 30, 2013.

Recommendation
That in accordance with provisions of Sections 1006.07(1)(a)(b), Florida Statutes and School Board Policy 5.34, the holding of a hearing having been waived by the student/parent, the recommendation as specified in Expulsion Case No. 12-250, to expel the student referenced therein from the Sarasota County Schools, be approved effective immediately for the remainder of the 2011-2012 academic year, the 2012 summer session, until January 30 of the 2012-2013 academic year.

Description

Recommendation
That in accordance with provisions of Sections 1006.07(1)(a)(b), Florida Statutes and School Board Policy 5.34, the holding of a hearing having been waived by the student/parent, the recommendation as specified in Expulsion Case No. 12-244, to expel the student referenced therein from the Sarasota County Schools, be approved effective immediately for the remainder of the 2011-2012 academic year, the 2012 summer session, until January 18 of the 2012-2013 academic year.

Description

Description

25. APPROVAL OF EXPULSION CASE NO. 12-141
Description

The student listed in Expulsion Case No. 12-141 is in violation of an accepted Expulsion Settlement Agreement for alternative school placement. On November 10, 2011 the student listed in Expulsion Case No. 12-141 violated School Board Policy 5.34 (1) (a), possessed, used, or sold an alcoholic beverage, any illegally controlled substance, or paraphernalia capable of modifying mood or behavior including any substance that is held out to be represented to be any illegal or controlled substance.  It is the recommendation of the Superintendent that the student be expelled from the Sarasota County Schools until June 30, 2012.



Recommendation

That in accordance with provision of Sections 1006.07 (1) (a) (b) Florida Statutes and  School Board Policy 5.34 the holding of a hearing having been waived by the student/parent, the recommendation as specified in Expulsion Case No. 12-141 to expel the student referenced therein from the Sarasota County School be approved effective immeditely for the remainder of the 2011-12 academic year.

MATERIALS MANAGEMENT

26. APPROVAL TO AWARD BID #12-0124 FOR AUTOMOTIVE/LIGHT TRUCK REPAIR PARTS
Description
Bids to provide 'Automotive/Light Truck Repair Parts' were received from six vendors on March 20, 2012.  The bids of Auto Plus, Fleet Pride, NAPA Auto Parts, The Parts House, and Vehicle Maintenance Program were the best low bids meeting the advertised specifications.  Reasons for not selecting the apparent low bid are included with the bid tabulation.  This bid is for a period of one year with the option to renew for two additional one-year periods.  The funds for these purchases are contained in the operating budget allocated to the Transportation Department.

Recommendation
That the bids of Auto Plus, Fleet Pride, NAPA Auto Parts, The Parts House, and Vehicle Maintenance Program, to provide 'Automotive/Light Truck Repair Parts' in an amount not to exceed $125,000, be approved for award and purchase.

27. APPROVAL OF CLASSIFICATION OF INOPERATIVE EQUIPMENT AND FURNITURE AS PROPERTY TO BE DELETED
Description
The custodians of the property (cost center heads) have certified it to be traded in on new equipment, unaccounted for, not repairable or otherwise inoperable.  Property still on hand after reallocation will be salvaged for any useful parts and then sold at auction.   

Recommendation
That the classification of equipment and furniture, as property to be deleted, be approved.

28. APPROVAL TO RE-AWARD BID #12-0133 FOR WORKPLACE UNIFORMS
Description
Bids to provide 'Workplace Uniforms' were received from four vendors on June 14, 2011.  The cloth uniform items were awarded to Monica Manufacturing dba All Uniform Wear.  Monica Manufacturing dba All Uniform Wear is unable to comply with specifications related to delivery, fitting services and accuracy of orders so these items are being re-awarded to Itchin' to bee Stitchin' based on the original sealed scenario.  This bid is for a period of one year from the original award date of July 19, 2011 with the option to renew for two additional one-year periods.  The funds for these purchases are contained in the operating budgets allocated to the departments.       

Recommendation
That the cloth uniform items for the 'Workplace Uniforms' bid be re-awarded to Itchin' to bee Stitchin' in addition to previously awarded items.

FACILITIES

29. ACCEPTANCE OF FACILITIES' SERVICES PROJECT COMPLETION AND APPROVAL OF FINAL PAYMENT TO CONTRACTOR FOR THE BAY HAVEN STAGE UPGRADE FOR ADA RENOVATION
Description
All work has been completed and all required close-out documents have been received from the contractor.  The final project costs have been internally audited and are enclosed herein in Change Order #1 for approval.  The Director of Facilities Services has determined that the project is complete in accordance with state statutes.

Recommendation
That the project be accepted as complete and the final payment to the contractor be approved as presented.

CONSTRUCTION

30. APPROVAL AND/OR RATIFICATION OF CONSTRUCTION SERVICES' CHANGE ORDER(S)
Description

The Construction Services' Change Order(s) are summarized on the enclosure for ease of review.  These change orders collectively total a decrease of $754,673.12 in gross contract dollars.

Included in these change orders are $737,232.68 credits for Direct Material Purchases; the corresponding Direct Material Purchase Orders of $695,030.82 result a net of $42,201.86 in sales tax savings.



Recommendation
That the Construction Services' Change Order(s) be approved and/or ratified as presented.

31. APPROVAL OF CONSTRUCTION MANAGER'S PRECONSTRUCTION SERVICES CONTRACT FOR THE BOOKER MIDDLE SCHOOL - HVAC RENOVATION PROJECT
Description
The project's scope of work shall include replacement of the complete HVAC system and renovation of all affected spaces.  On 4/17/2012 (Item #15), the School Board authorized negotiations with this company.  On 5/18/2012 the Director of Construction Services Designee and a member of the Professional Services Selection Committee (PSSC) met with a representative from Jon F. Swift, Inc. to negotiate a contract for this project.  This contract covers the pre-construction portion only for this project. The contract documents have been approved by the School Board attorney and are available for review at the Construction Services Department.  The construction budget is approximately $10,000,000.00.  Funds, in the amount of $2,000,000.00 for this project are available in the capital budget account.

Recommendation
That the construction manager's preconstruction services contract for the Booker Middle School - HVAC Renovation project be approved as presented.

FINANCE

32. RENEWAL OF TSA CONSULTING GROUP ADMINISTRATION SERVICES AGREEMENT EFFECTIVE JULY 1, 2012 THROUGH JULY 30, 2013
Description

In April 2011, the Board executed an administration services agreement with TSA Consulting Group for Internal Revenue Code 403(b) compliance services and educational and third party administration program services.  The agreement provides for annual contract renewals with a 3% increase in service fee each year until June 30, 2016.  This renewal will be for year 2 (7/1/12 through 6/30/13) at the rate of $5.15 per year per participant billed monthly.   



Recommendation
That the year 2 renewal of the administration services agreement, effective July 1, 2012 through June 30, 2013, with TSA Consulting Group, be approved as presented.

33. APPROVAL OF THE SUPERINTENDENT'S FINANCIAL STATEMENTS FOR THE MONTH OF MARCH 2012
Description
The Superintendent's Financial Statements for the month ending March 31, 2012 does not reflect any unexpected trends for the 2011-2012 fiscal year.  Deficit spending will continue in the General Fund as fund balance has been budgeted to decrease this fiscal year due to State revenue shortfalls and reduced property tax revenues.  The large variance between 2012 and 2011 on the District's balance sheet at March 31, 2012 for accounts payable is a result of the implementation of the Crosspointe software in August 2011.  The District is now more appropriately reflecting our accounts payable liabilities and actual expenses in the period they are incurred rather than the period paid. 

Recommendation
That the Superintendent's Financial Statements for the period of March 1st through March 31st, 2012 be approved as presented.

New Business
34. APPROVAL OF ARCHITECT'S CONTRACT FOR SARASOTA HIGH SCHOOL RENOVATION AND NEW CONSTRUCTION PROJECT
Description

The scope of work at time of contract shall include the renovation of Building #42 to accommodate classroom space, the renovation of Building #4, the construction of a new gymnasium, campus improvements to include necessary site work to support the overall project, the construction of a new bus loop and identified demolition of existing buildings around campus.   The Director of Construction Services and a member of the Professional Services Selection Committee (PSSC) met with representatives of Harvard Jolly Architecture and successfully negotiated a contract.  This contract is for architectural design services including new construction, renovation, site work, identified campus demolition and contract administration.  The cost of Basic Services at time of contract is $1,232,000.00 and the cost of identified Additional Services at time of contract is $155,000.00.  These contract documents have been approved by the School Board Attorney and are available for review at the Construction Services Department.  The Construction Budget is approximately $22,000,000.00.  Funds for this project are available in the Capital Budget.



Recommendation

That the Architect's contract for the Sarasota High School Renovation and New Construction Project be approved as presented.



35. APPROVAL OF CONSTRUCTION MANAGER'S PRE-CONSTRUCTION SERVICES CONTRACT FOR SARASOTA HIGH SCHOOL RENOVATION AND NEW CONSTRUCTION PROJECT
Description

Hayes, Inc. dba Tandem Construction to negotiate a contract for this project.  This contract covers the pre-construction portion only for this project.  The contract for construction will be negotiated separately at a later date.  This contract amount is $187,000.00.  These contract documents have been approved by the School Board attorney and are available for review at the Construction Services Department.  The construction budget is approximately $22,000,000.00.  Funds, in the amount of $22,000,000.00 for this project are available in the capital budget account.

Recommendation
That the construction manager's pre-construction services contract for Sarasota High School Renovation and New Construction Project be approved as presented.

36. APPROVAL OF PROCUREMENT AND RECORD DOCUMENT SPECIALIST JOB DESCRIPTION
Description

This job description supports an eventual reorganization of the Construction Services Department that recognizes upcoming changes in workload and, in response, eliminates two positions, combines them into one, and ensures the Department the skills they need to be successful.
